1. Object:
The purpose of these general terms and conditions of sale is, on the one hand, to inform any potential consumer about the terms and conditions under which the seller proceeds with the sale and delivery of the ordered products, and on the other hand, to define the rights and obligations of the parties in the context of the sale of products by the seller to the consumer. They apply, without restriction or reservation, to all sales by Bandeja shop of products offered on its website.

Consequently, the fact that any person orders a product offered for sale on the Bandeja shop website implies full and complete acceptance of these general terms and conditions of sale, which the Buyer acknowledges having read prior to ordering.

Bandeja shop reserves the right to modify these terms and conditions at any time.

3. Prices:
The selling prices of the products online on the Bandeja shop website, indicated in Euros, are those in effect at the time of the registration of the order form by the Buyer.

They do not include shipping costs, which are invoiced in addition to the price of the products purchased, depending on the amount of the order. Shipping costs will be indicated before the Buyer places the order.

The selling prices of the products can be changed by Bandeja shop at any time. The Buyer will be informed of this change before placing an order.

 

4. Product characteristics:
In accordance with article L 111-1 of the French Consumer Code, the Buyer may, prior to placing an order, take note of the essential characteristics of the product(s) he wishes to order on the Bandeja shop website.

The offers presented by Bandeja shop are valid while stocks last. For products not stocked in its warehouses, the offers presented by Bandeja shop are valid subject to availability from its suppliers.

The photographs, graphics and descriptions of the products offered for sale are indicative only and are not binding on the seller. In the event that a supplier modifies a product, the seller cannot be held responsible for the graphic representation of the product or even affect the validity of the sale.

 

5. Order:
All orders imply full and unconditional acceptance of these general terms and conditions of sale.

The Buyer can order on our website.

The Buyer's order must be confirmed by Bandeja shop by e-mail.

The sale will only be considered final after Bandeja shop has sent the Buyer an order confirmation and has received the full price.

Bandeja shop recommends the Buyer to keep this information on a paper or computer document.

 

6. Payment:
Payment must be made at the time of ordering by the Buyer. At no time may the sums paid be considered as a deposit or advance payment.

The full amount of the order will be collected by Bandeja shop when the order is validated.

All orders are payable in Euros. To pay for his order, the Buyer has all the means of payment mentioned in the order form: online credit card (Visa or Mastercard), or bank transfer.

Bandeja shop reserves the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in case of non-payment of any amount due by the Buyer or in case of a payment incident.

Penalties of an amount equal to the legal interest rate increased by five points are automatically applicable to amounts unpaid at the end of a period of ten days following the date of invoicing or upon notification of the rejection of bank payment for any other means of payment. The delivery of any new order may be suspended in the event of late payment of a previous order, notwithstanding the provisions hereof.

Bandeja shop reserves the right to request a photocopy of the Buyer's identity card for any payment by credit card.

As part of the fight against Internet fraud, information relating to your order may be transmitted to any third party for verification.

Processing time for payment methods:
- Credit card: Immediate
- Bank transfer: 1 to 2 days upon receipt of payment
- Payment in 3 or 4 instalments: 1 to 2 days upon receipt of supporting documents


7. Choice of products:
The Buyer, having taken note of the products and their characteristics marketed by Bandeja shop, has under his sole responsibility and according to his needs as previously determined before any order, made his choice on the product(s) being ordered. Furthermore, the buyer, knowing only the products he owns and uses, is the sole judge of the compatibility of the products ordered with those used by him.

Bandeja shop provides the buyer with an e-mail help service to assist them in their choice, the addresses of which can be found in the "Contact us" section.

 

8. Delivery and reception: 
8.1. General regulations
The products will be delivered to the address indicated by the Buyer on the order form.

The Buyer may, at his or her express request, have the invoice sent to the billing address and not to the delivery address by validating the option provided for this purpose on the order form.

The shipping costs are automatically calculated in the customer's order basket according to the weight and volume of the items in the shopping cart.

8.2. Shipping costs
Shipping costs include preparation, packaging and transport costs. These costs are indicated when the order is being placed, before validation and payment, and may vary depending on the Customer's destination address and the total amount of the purchase.

8.3. Delays
It is important to differentiate between delivery times and shipping times.

The shipping time is the time needed to prepare your order and hand it over to the carrier. It depends mainly on the availability of the ordered articles. This information is indicated directly in the article sheet.

- If the availability is "in stock": the product is in stock and your order will be prepared within 24 to 48 working hours.

- If the availability is "in supplier's stock": the product is in stock with our supplier. This means that we have to receive it first before we can prepare the order.

- If the availability is between 3 and 12 days: the product is not in stock. We have to order it from our supplier before preparing your order. But we are not sure of its availability because we are not interfaced with the supplier on this reference. In case of stock shortage or delay, we will inform you by e-mail.

IMPORTANT: All items in your order must be in stock for us to prepare the order. If a single product is not in stock, we will have to wait to receive it before we can prepare the order.

Once the order is ready, we hand it over to the carrier.

These times are given as an indication.

Any delay in delivery shall not give rise to damages, withholding or cancellation of the order by the Buyer.

In the event of a delay in delivery in relation to the date initially set, the Buyer must notify Bandeja shop in writing (email, customer support) in order to improve the quality of service that may be offered and to allow Bandeja shop.fr to proceed with an investigation with the carrier.

An investigation with the carrier may take up to 60 working days. If during this period the product is found, it will be immediately redirected to the place of delivery indicated in the order form.

In the event that the product ordered is no longer available, a refund or credit note will be offered.

8.4. Reception
The goods travel at the Buyer's risk.

Consequently and in any case, before accepting your delivery, please check the condition of your packages.

In case of anomaly, refuse the parcel if possible and and whatever the case, indicate on the delivery note the reasons for the refusal by listing the problems observed, otherwise, no claim will be possible.

IMPORTANT: Don't let the delivery person tell you what to do or what to write on the delivery note.

Limit yourself to indicating the damage actually found on the products, clearly indicating the deterioration of the item and not just on the parcel, packaging or box.

Avoid any information that the deliverer may give you, such as "intact packaging" or any other statement that could exclude their responsibility.

Finally, the reservation "subject to unpacking" is not valid and cannot be taken into account.

 

9. Product availability:
In case of partial availability of the items and depending on the nature and amount of the order, Bandeja shop.co.uk may exceptionally make a split delivery. Products in stock will be sent first. The remainder will either be delivered later, replaced by another item (in agreement with the Buyer), or refunded.

In any case, Bandeja shop will inform the Buyer as soon as possible.

10. Quality or compliance issues:
In the event of delivery of a product that does not correspond to the order (defective or non-conforming), the Buyer must make a complaint within 7 days of signing the delivery note.

In this case only, the return costs will be charged to Bandeja shop.

Complaints must be sent by letter, by email or by the after-sales service form available on Bandeja shop and must include :

- The buyer's contact details
- The product's references
- The reasons for the complaint
- 2 to 3 photos presenting the problem

Products must be returned within seven working days of the allocation of a return number by the Bandeja shop customer service.

If this is not the case, Bandeja shop will not exchange or reimburse the products ordered.

Any product to be exchanged or refunded must be returned to Bandeja shop in its original condition and packaging and must include the entire product and its accessories.

Any risk related to the return of the product is at the Buyer's expense.

In the absence of compliance with the procedure set out above and the time limits indicated, the Buyer may not make any claim for non-conformity or apparent defect of the products delivered, the products being deemed to be in conformity and free of any apparent defect.

11. Right of Cancellation:
• The Buyer has a period of 60 days from the date of receipt to return the ordered products for refund at his own expense.

The Buyer must inform Bandeja shop, and the return can only be made after the latter has given its consent and issued a return number which must be written on the packaging.

• The products must not have been used and must be returned to Bandeja shop in perfect condition for resale, in their original state (packaging, accessories, instructions, etc.), properly sealed, and accompanied by the invoice for the purchase.

If the product includes a guarantee sheet or any other document to be completed, this must not be filled in so that the buyer can exercise his right of withdrawal.

Any product that is incomplete, damaged or whose original packaging has been damaged will not be refunded or exchanged.

• The exercise of the right of withdrawal will give rise to the choice of the buyer:

- or to a cash refund by re-crediting the credit card entered at the time of the initial order or, if this is not possible, by wire transfer
- or a voucher to be used at Bandeja shop

• In all cases, the return costs will be charged to the customer.

• In case of an exchange with another product, the new shipping costs will be due to Bandeja shop.

12. General conditions of refund:
Subject to the special provisions set out in point 9 above, any refund payable by Bandeja shop will be made in the form of a voucher to be used on our site.

The average time for a refund is approximately 10 days.

In any case, Bandeja shop will communicate the awarding of the voucher by e-mail:

- It is valid for one year,
- Whether or not the buyer will be able to request a refund,
- Its amount.

In the event of partial use of the voucher, the remainder will remain available to the customer under the same conditions as the original credit.

A voucher will be considered as used if it is used, even partially, or if a refund is requested.

By the very fact of using this voucher, the consumer undertakes on his honour not to contest or oppose the transaction concerned by the refund with his bank or otherwise, and undertakes not to do so within a period of one year following the use of the voucher.

The consumer acknowledges that he/she is aware that any breach of this obligation will expose him/her to the return of the sum unduly received, without prejudice to any damages that may be claimed by Bandeja shop.

13. Warranty:
Some of the products sold are covered by a manufacturer's warranty, the terms and conditions of which vary from one supplier to another. The general terms and conditions and the duration of the warranty are available on the Bandeja shop website. The buyer is deemed to have read and accepted them.

Any return of the product under the aforementioned warranty must be approved by Bandeja shop in advance. To this end, the buyer should contact the Bandeja shop customer service department.

No returns will be accepted without prior authorization from Bandeja shop.

If the product is found to be defective, Bandeja shop will provide the Buyer with a product return number. This return number, which is a crucial and indispensable condition, is valid for seven working days, starting from the communication of the return number by Bandeja shop to the Buyer. After this period, the Buyer will have to renew his request, according to the procedure described above.

The defective product must be returned in its original packaging, include the entire product and its accessories and be legibly accompanied by the product return number provided by Bandeja shop and the product serial number.

Any product that is incomplete, damaged and/or whose original packaging has been damaged will not be accepted for return or exchange under the guarantee.

All costs and risks related to the return of the product are to be borne by the Buyer.

Please note that for re-shipments outside metropolitan France, a financial contribution to the transport costs may be requested.

The product under warranty will, at the manufacturer's option, be exchanged or repaired.

Bandeja shop guarantees the Buyer, with respect to hidden defects that may affect the delivered products, only within the framework of a replacement of the defective products, or of the parts that render them unfit for use, without being able to be considered by the Buyer as being responsible for the possible harmful consequences that these hidden defects may have caused.

In any case, the guarantees do not cover:

- Replacement of consumables.

- Abnormal and improper use of the products.

- Damage that is specifically mentioned in the item sheets.

- Defects and their consequences due to the intervention of the Buyer or a repairer not approved by Bandeja shop.

- Defects and their consequences due to use that does not comply with the product's intended purpose (professional, collective use, etc.).

- Products that are subject to a specific support and maintenance contract.

14. Responsibility:
The products offered by Bandeja shop comply with current French legislation.

Bandeja shop cannot be held responsible for the non-execution of the contract in case of stock shortage or unavailability of the product, major force, disruption or total or partial strike, particularly of the postal services and means of transport and/or communications.

Bandeja shop cannot be held responsible for any indirect damage that may occur as a result of the purchase of the products.

Bandeja shop cannot be held responsible for the total or partial impossibility to use the products, in particular due to hardware incompatibility, nor can it give rise to any compensation or reimbursement.

The Bandeja-shop.com website also contains information from third parties and links to other websites. Bandeja-shop.com shall not be liable for any damages resulting from the use of, access to, or inability to use such third-party information, nor for the content of other websites.

15. Partial invalidity:
If one or more provisions of these general terms and conditions of sale are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other provisions shall retain all their force and scope.

16. Non renunciation:
The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations referred to in these general terms and conditions of sale shall not be interpreted for the future as a waiver of the obligation in question.

17. Applicable law:
The sales of products by Bandeja shop are subject to French law.

18. Information Technology and Liberties:
The information collected by Bandeja shop during any order from the Buyer is necessary for the management of his/her order by Bandeja shop and its commercial partners. In accordance with the French Data Protection Act n°78-17 of 6 January 1978, the Buyer has the right to access, rectify, oppose and delete data concerning him/her at Bandeja-shop.com .

19. Mediation service:
In accordance with the provisions of the Consumer Code concerning the amicable settlement of disputes, Bandeja shop is a member of the FEVAD ("Fédération du e-commerce et de la vente à distance") E-commerce Mediation Service whose contact details are as follows: 60 Rue La Boétie - 75008 Paris - http://www.mediateurfevad.fr.
